Welcome to Simple SpEd Reports ("Service"), a web-based platform designed to assist school psychologists and other special education professionals with report writing, template creation, assessment documentation, and AI-assisted content generation.

By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Eligibility

The Service is intended for use by licensed professionals and educational personnel, including but not limited to:

• School Psychologists
• Special Education Teachers
• Speech-Language Pathologists (SLPs)
• Occupational Therapists (OTs)
• Educational Diagnosticians
• Educational Evaluators
• Other qualified special education professionals

The Service is not intended for use by minors under the age of 18.

2. Professional Responsibility

Simple SpEd Reports is a productivity and report-writing assistance tool only.

Users remain solely responsible for:

• Evaluation conclusions
• Eligibility determinations
• Recommendations
• Interpretation of assessment results
• Compliance with federal, state, and local requirements
• Final report content
• Educational and professional decisions

The Service does not replace professional judgment, independent evaluation, supervision requirements, or ethical obligations.

3. Student Information and Privacy

Users should avoid entering personally identifiable student information ("PII") into the Service whenever possible.

Examples of PII include:

• Student names
• Dates of birth
• Student identification numbers
• Addresses
• Phone numbers
• Social Security numbers
• Any information that could reasonably identify a specific student

Users are solely responsible for ensuring their use of the Service complies with:

• FERPA
• Applicable state privacy laws
• School district policies
• Employer requirements
• Professional ethical standards

Users should only enter information they are authorized to store, process, or transmit.

4. AI-Generated Content

The Service may provide artificial intelligence ("AI") features, including report-writing assistance, testing narratives, assessment summaries, template generation, and other content generation tools.

AI-generated content is provided solely as a drafting and productivity aid.

Users acknowledge and agree that:

• AI-generated content may contain errors or inaccuracies.
• AI-generated content may be incomplete.
• AI-generated content should never be accepted without review.
• Users must independently verify all generated content.
• Users remain fully responsible for all final report language.
• Users are solely and exclusively liable for reviewing, verifying, editing, and approving all AI-generated content before it is used, submitted, or relied upon in any professional, educational, or legal context.
• Simple SpEd Reports bears no responsibility for consequences resulting from a user's failure to review AI-generated content prior to use.
• No attorney-client, therapist-client, or other professional advisory relationship is created between the user and any AI provider whose model powers the Service.

Simple SpEd Reports makes no guarantee regarding the accuracy, reliability, completeness, legality, or appropriateness of AI-generated content.

5. Third-Party AI Providers

The Service uses third-party artificial intelligence models and APIs (including but not limited to models provided by Bastion GPT or other AI vendors) to generate content. Simple SpEd Reports:

• Does not own, control, or guarantee the outputs of these third-party AI systems.
• Is not responsible for errors, outages, changes in behavior, model updates, or discontinuation of any third-party AI provider.
• May change AI providers, models, or underlying infrastructure at any time without notice.
• Passes through no warranties from any AI vendor to the user.

While Simple SpEd Reports takes reasonable steps to work with AI vendors that maintain appropriate data protection standards, users acknowledge that:

• Any information submitted to the Service, including through AI features, may be processed by third-party AI infrastructure.
• Simple SpEd Reports is not responsible for a third-party AI vendor's compliance with FERPA or other privacy laws with respect to data the user chooses to submit.
• Users remain solely responsible for ensuring they do not submit PII or other protected student information to the Service, consistent with Section 3 above.

6. Data Storage

The Service may allow users to save report language, templates, assessment information, and other content.

Users are responsible for:

• Reviewing saved information
• Updating outdated content
• Removing information that should no longer be retained
• Ensuring compliance with applicable privacy requirements

Simple SpEd Reports does not assume responsibility for user-entered content.

7. Security

We implement reasonable administrative, technical, and physical safeguards designed to protect information stored within the Service, including:

• Encrypted connections (HTTPS)
• Secure cloud hosting infrastructure
• Authentication controls
• Routine system maintenance and monitoring

However, no internet-based service can guarantee absolute security.

Users acknowledge that use of the Service is at their own risk.

8. User Accounts

Users are responsible for maintaining the confidentiality of their login credentials.

• Upload malicious software or code
• Attempt unauthorized access to the Service

• Copy, scrape, or reverse engineer the Service
• Use automated systems to extract platform content or functionality

11. Intellectual Property

The Service, including but not limited to:

• Software
• Design
• User interface
• Branding
• Graphics
• Features
• AI workflows
• Test generation systems
• Proprietary functionality

is the exclusive property of Simple SpEd Reports and is protected by applicable intellectual property laws.

Users retain ownership of report content they create using the Service.

Users may not reproduce, distribute, reverse engineer, resell, or create competing products based on proprietary features of the Service.

12. Service Availability

We strive to provide reliable access to the Service but do not guarantee uninterrupted availability.

We may:

• Modify features
• Update functionality
• Perform maintenance
• Suspend access
• Discontinue services

without prior notice.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMPLE SPED REPORTS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND RELIABILITY.

WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF SECURITY VULNERABILITIES.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMPLE SPED REPORTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO USE OF THE SERVICE.

THIS INCLUDES, WITHOUT LIMITATION:

• Loss of data
• Loss of business
• Loss of revenue
• Educational decisions
• Eligibility determinations
• Report content errors
• AI-generated content errors
• Third-party AI provider errors, outages, or discontinuation
• Service interruptions

YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

15. Indemnification

You agree to defend, indemnify, and hold harmless Simple SpEd Reports, its owners, employees, contractors, and affiliates from any claims, damages, liabilities, costs, or expenses arising from:

• Your use of the Service
• Violation of these Terms
• Violation of applicable laws or regulations
• Content you create or submit through the Service

16. Termination

We reserve the right to suspend or terminate access to the Service at any time for:

• Violations of these Terms
• Misuse of the Service
• Security concerns
• Non-payment
• Any other reason deemed necessary to protect the Service or its users
